Article 1

Organizing company


MKG GROUP SAS with a capital of 61 091.50 € having its registered office at 5 rue de Danzig 75015 Paris, having the identification number RCS 379 089 295 000 16 and represented by Mr. Vanguelis PANAYOTIS, President (hereinafter also referred to as the "Organizing Company" or "the Organizer") is organizing on Tuesday November 30, 2021, an international event entitled the "Hospitality Awards", according to the terms and conditions described in these rules.

Presentation of the event

‍
Hospitality ON has undertaken to highlight the initiatives of the global hotel industry throughout the Hospitality Awards. This event is an opportunity for hotel owners; hospitality professionals and hotel schools to highlight the exemplary achievements of their teams in the following categories.

Article 3

Description of the categories

1. Best Advertising Campaign
This award recognizes a marketing operation or campaign designed to enhance, promote, or relaunch a brand, a product or a concept through innovative initiatives, tools and partnerships.

2. Best Marketing Operation
This award recognizes a specific action/program in the area of sustainable development (ecological aspects excluding social aspects) aimed at local populations and employees, and/or tourist sites and natural resources.

3. Best Initiative in Sustainable Development
This award recognizes a specific action/program in the area of sustainable development (ecological aspects excluding social aspects) aimed at local populations and employees, and/or tourist sites and natural resources.
‍
4. Best Initiative in Social Responsibility
This award recognizes a specific action/program in the area of social responsibility (excluding environmental aspects) towards local populations and employees, and/or tourist sites and natural resources.
‍
5. Best Initiative in Talent Management
This award recognizes the exemplary of an action/program of a human resources management in terms of recruitment, new employee integration, talent development, diversity, career development, empowerment and automation, performance improvement, motivation, and social climate.

6. Best Accommodation Concept - Group Initiative
This award recognizes a new concept from a group, a brand, or a solo establishment, which demonstrates the sector's ability to innovate and renew its product offering. The concept brings a different vision of comfort and/or a better quality of service for customers in terms of decoration, space planning and technology, etc.

7. Best Accommodation Concept - Individual Initiative
This award recognizes a new concept from a group, a brand, or a solo establishment, which demonstrates the sector's ability to innovate and renew its product offering. The concept brings a different vision of comfort and/or a better quality of service for customers in terms of decoration, space planning and technology, etc.

8. Best Wellness Experience
This trophy rewards a new concept, a new service, or a particular initiative of a group, a brand, or a hotel that demonstrates the sector's ability to innovate and renew itself. This concept brings a different vision of comfort and/or a better quality of service for customers in terms of catering concept, room service, bar and restaurant areas, banquet offer...

9. Best F&B Experience
This award recognizes a new concept, a new service, or a particular initiative by a group, a brand, or a hotel that demonstrates the sector's ability to innovate and renew itself. This concept brings a different vision of relaxation, fitness, and well-being in the broadest sense, including fitness and spas.

10. Iconic Asset
This award recognizes a flagship and emblematic establishment that represents its group and/or brand and demonstrates its ability to invest to surprise, attract attention and delight its customers and partners.

11. Best Team Achievement
This trophy rewards a company's team that has contributed to a significant improvement in the company's performance, customer recognition, and quality of service.
‍
12. Professional Success
This trophy is awarded to a former student who has been working as a hotelier for a maximum of 5 years and is less than 30 years old. This young professional must distinguish himself/herself by his/her academic results as well as by a promising professional career in the hotel industry. His actions or missions must testify to his potential and motivation to help his company and the hotel industry to evolve.

Applications from young employees are submitted by a hotel school or tourist accommodation. The tourist accommodation submitting the application must have obtained prior validation of its choice by the school concerned. Under no circumstances will the organizing company interfere in the process of validating applications between the hotel school and the tourist accommodation, and the organizing company must not inform the hotel school, or the tourist accommodation concerned of the applications received by the hotel schools or tourist accommodation. The organizing company will not be held responsible if one of the two sides does not obtain the agreement of the other side to present the selected application.

13. Lifetime Achievement
This trophy will be awarded by the Advisory Board to an international hotel or tourism personality who has made a mark on the profession through his or her pioneering, innovative, entrepreneurial, and professional achievements.

14. Grand Prix
This trophy will be awarded to a company in the international hotel industry that has marked the year 2021 by its performances in four complementary areas: development, innovation, human resources, and commercial performance.

Article 4
‍
Conditions of participation

‍
Participation in this event is open to professionals of all types of hotels and tourism and more particularly to all Hotel Groups / Integrated Hotel Chains / Voluntary Chains / Franchised Hotels / Hotel Residences / Resorts & Clubs / Campsites / Hostels / Tourist accommodations / Cruise ships / Hotel schools and to any natural person of legal age representing a hotel throughout the world (hereinafter referred to as "Candidates"), with the exception of the Organizing Body's employees and their families.

The event is announced on the following communication media:

- Hospitality ON Magazine, and e-mailing campaigns

Article 6
‍
Terms and conditions of participation
‍

To participate in this event, candidates must register on the online store send their application to the Organizing Company. Each application submitted to the Hospitality Awards is subject to a survey, supervised by the Advisory Board. Applications must be presented in the form of a PDF slideshow, following the different sections of the survey in French or English, a summary of no more than 5,000 characters, which must be in English, a high-definition picture of the project and a high-definition logo of their brand. These compulsory documents may be accompanied by other materials such as brochures, pictures, and videos. The candidates expressly grant the Organizing Body the right to use the logo of their brand on its websites hospitality-on.com and www.hospitalityawards.com, accessible worldwide, for the duration of the legal protection in France of the intellectual property rights relating to the said logos. The selected finalists must provide a one-minute video illustrating their application. These elements will be used during the ceremony. Completed applications must be submitted online on the Hospitality ON website by the candidates who give permission to the organizer to publish them on the above-mentioned websites during the event, without prejudice to the provisions of Article 20 below. In the case where the candidate does not wish to publish certain documents, he/she must inform the organizer in advance. In any case, the organizer will not be held responsible for the publication of the documents given.  

The applicant shall also ensure that the application file complies with the laws and regulations in force in France. In particular, the Applicant guarantees that the application file will not contain any elements that are contrary to good morals, insulting, defamatory, infringing, xenophobic, homophobic, anti-Semitic, etc.

Receipt of applications: from September to October 29, 2021 included for the following categories Best Advertising Campaign / Best Marketing Operation / Best Initiative in Sustainable Development / Best Initiative in Talent Management / Best Accommodation Concept / Best Wellness Experience / Best F&B Experience / Iconic Asset / Best Team Achievement / Best Professional Success.  

Entries cannot be submitted to compete in the Lifetime Achievement and Grand Prix categories. For these categories, the finalists are chosen by the Hospitality ON Jury or Advisory Board from among the tourism companies that have caught their attention.  

Participation in the Hospitality Awards implies full and unconditional acceptance of these rules. By accepting the terms of these rules, the Candidates agree that these rules shall be effective retroactively to September 2021.  

Article 7

Participation fees

‍
No participation fees will be charged in 2021. The Candidate will have until October 29, 2021 to register on the online store.

Each application file includes the invitation of a person who may be replaced at any time, for the award ceremony that will take place on Tuesday, November 30, 2021 at the InterContinental Paris Le Grand Hotel.

Article 7 (bis)

Participation in the Ceremony

‍
The participation of the public in the award ceremony is done by registering with the Organizer at the following address: 5 rue de Dantzig 75015 Paris / events@hospitality-on.com until the day of the Event, November 30, 2021, included.
‍
The participation of the public to the award ceremony amounts to 350 euros (excluding VAT) per participant. Participants must pay their participation fees upon receipt of the invoice issued by the Organizing Body.

Payment can be made by bank transfer and credit card online.

Registration is non-refundable; however, the participant has the possibility to be replaced by a collaborator at any time.

Due to the limited number of places available, Hospitality ON reserves the right to give priority to hoteliers, clients, and partners, according to the quotas set by profile category.

Participants in the awards ceremony agree that their name and photograph may be used in online publicity materials (websites of the Organizing Company) in connection with the Hospitality Awards, worldwide and for a period of ten (10) years from the date of their participation in the awards ceremony, without reference, payment, or compensation.

Article 8

Advisory Board or Pilot Committee

‍
The Advisory Board or Pilot committee is composed of a president and about twenty representatives of hotel schools, hotel groups and economic personalities. It is the guarantor of the smooth running of the selection stages by defining the categories and the rules of the event.

Article 9
‍
Juries

‍
The selection of finalists and some winners will be made by two (2) juries as described below.
‍
The various Hospitality Awards Juries reserve the right to divide all categories into two sub-categories depending on the number and nature of entries received. For example, deployed concept and individual initiative

- A deployed concept is an innovation implemented by a hotel group or network with more than 5,000 rooms and intended to be implemented in several establishments. An innovation carried out in a single establishment, even by a hotel group or network with more than 5,000 rooms, will be considered as an individual initiative.

- An individual initiative is an innovation carried out within an independent hotel or a single establishment for a hotel group or network.  
‍
The organizing company reserves the right to withdraw one or more categories from the competition if the number of applications received for this or this category(ies) is not sufficient or representative. In this case, the organizing company will inform the candidates of its decision to withdraw the category for which the candidates concerned have applied. The candidate will then have the choice between having his or her application moved to a new category or, if he or she does not wish to compete in this new category, being reimbursed for the participation fee.

The various juries reserve the right to move an entry from one category to another if they feel the entry is more appropriate for the new category.

9.1. The Hospitality Awards Jury is composed of a chairman and approximately 40 personalities from the business and communication world, excluding the hotel and restaurant industry (the "International Jury"). It will meet to select:

9.1.1. Finalists in the following categories:
- Best Advertising Campaign
- Best Marketing Operation
- Best Accommodation Concept - Group Initiative
- Best Accommodation Concept - Individual Initiative
- Best Wellness Experience
- Best F&B Experience

9.1.2. Finalists and winners in the following categories:
- Best Initiative in Sustainable Development
- Best Initiative in Social Responsibility (see article 11 below)  
- Best Accommodation Concept - Individual

9.2. The Jury Advisory Board consists of a chairman and approximately 20 representatives of Hospitality Awards hotel groups (the "Jury Advisory Board"). The Jury will meet to select the Finalists/Winner in the following category:
- Lifetime Achievement "Pioneer/Entrepreneur" (see Article 11 below).

9.3. The jury for the selection of finalists for the categories, "Iconic Asset", "Best Team Achievement", "Best Professional Success" and " Grand Prix Hospitality ON" shall be constituted by the editorial staff of Hospitality ON (the "Hospitality ON Jury"). This jury is made up of a president and about ten members and will meet in November 2021 at the premises of the Organizing Company.

The selection of the members of the various juries shall be made solely by the Organizing Body and may not be contested. The list of members of the juries and of the steering committee will not be disclosed to avoid attempts at corruption.

Article 10
‍
Selection criteria and procedures

‍
The applications will be evaluated according to the following three criteria:
1. The innovative aspects of the projects presented.
2. The exemplary nature of the operation and its capacity to be multiplied or extended.    
3. The effectiveness of the actions implemented in terms of economic benefits.

Selection procedures
‍
The determination of the finalists and winners may follow a process containing up to three stages, with the intervention of a specific jury according to the categories as specified in article 9 above. The different juries reserve the right to decide not to put a category to public vote. They may also decide to add a category to the public vote. No information on the selections will be revealed before the day of the ceremony, neither by the juries, nor by the organizing team or any other person who has access to the results before the ceremony.

First stage: voting by Internet users registered on the Hospitality-ON.com website

From November 2021, Internet users registered on the Hospitality-ON.com website will have the opportunity to express their choice by voting for the Iconic Asset category posted online, to guide the selection presented to each specific jury if necessary. Internet users will be able to vote for 1 favorite candidate per category. The organizing company cannot be held responsible for the results of the votes due to the delay in receiving the application files. The results of the online votes will not be communicated to the candidates.

Second stage: intervention of the juries

I) Pre-selection by each specific jury
The International Jury, meeting in November 2021, will make its own choice among the submissions to determine the finalists in the following categories
- Best Advertising Campaign
- Best Marketing Operation
- Best Accommodation Concept - Group Initiative
- Best Accommodation Concept - Individual Initiative
- Best Wellness Experience
- Best F&B Experience

II) Selection

1) The International Jury, meeting in a deliberative session in November 2021, will make its own selection from the submissions to determine the finalists and winners in the following categories:
- Best Initiative in Sustainable Development
- Best Initiative in Social Responsibility
- Best Accommodation Concept – Individual

2) The Hospitality ON jury will select the finalists and winners in November 2021 in the following categories:
- Best Team Achievement  
- Best Professional Achievement  
- Grand Prix Hospitality ON
- Iconic Asset (finalists only, category will be voted on from the floor on November 30 to determine the winner).  

3) The Jury Advisory Board, meeting in November 2021, will select the winner in the following categories:
- Lifetime Achievement " Pioneer/Entrepreneur"

Scoring System:
‍
Scoring will be as follows:
- Jurors will score the criteria for each category between 1 (lowest score) to 5 (highest score).
- The total amount of the points collected by each Candidate will produce a ranking to determine the 3 finalists for each category concerned.  
- There will always be only 3 places available for the final. In case of equality (for 1st place), the jury may proceed to a new vote to decide between the tied Candidates or may decide to award the prize to the two tied Candidates (in this case, only the 2nd place Candidate will be retained as a finalist). In the event of a tie (for 3rd place), the jury will hold a new vote to decide between the tied Candidates. In case of equality for 2nd place, both Candidates will be qualified for the final without being separated except in the case of a tie for first place. However, the jury may, if it wishes, submit more than 3 candidates to the vote of the audience if it does not wish to break the tie.  

For individual categories, the jury reserves the right to award the prize to the second choice if the first-place candidate cannot attend the ceremony on November 30, 2021. Therefore, the Organizing Committee will check with the winner before the Chairman of the Advisory Board hands over the envelope containing the winner's name to the bailiff on the day of the ceremony.

Once the results have been established, the presidents of the various juries will hand over the results to the bailiff at the end of the deliberations, except for the "Lifetime Achievement" category.

Third stage: electronic voting by the public during the ceremony

During the awards ceremony, which will take place on Tuesday, November 30, 2021, at the InterContinental Paris Le Grand, the public will be equipped with electronic voting devices and will contribute by voting, in the presence of a bailiff who will draw up the minutes of the voting operations, to determine the winner among the finalists designated by the International Jury in each of the following categories:
- Best Advertising campaign
- Best Marketing Operation
- Best Accommodation Concept - Group Initiative
- Best Wellness Experience
- Best F&B Experience
- Best Initiative in Talent Management

For these categories, the public vote is not weighted and will be decisive.
‍
If there is a tie for 1st place in the floor vote, the president of the jury concerned and the president of Hospitality ON may decide to award 2 trophies or proceed with a new vote.

Article 12
‍
Allocations

‍
A diploma attesting to their finalist status and signed by the president of The Organizing Company, the president of the ceremony, the president of the Advisory Board and the president of the relevant jury will be awarded to the finalist Candidates. A trophy will be awarded to the winner in each category. These prizes have no financial value.

Article 13
‍
Identification of winners and elimination of participation
‍
The Candidates and participants in the award ceremony accept that the Organizing Body reserves the right to verify their identity and any information contained in the registration form. Application forms that are not fully completed and/or contain incomplete or false contact information will not be taken into consideration and will result in the elimination of the participation without the Candidate being entitled to claim reimbursement of the registration fee.

Article 14

Modification of the dates of the event and extension of the number of prizes
‍
The Organizing Body shall not incur any liability whatsoever if it is forced to cancel the present event in the event of force majeure or events beyond its control. The Organizing Body also reserves the right, within the limits provided for by the law in force, to extend or limit the participation period, to postpone it or to modify the conditions thereof, and may not be held liable in this regard.

Additions and modifications may be made to these rules. They will be considered as amendments to these rules. The amendment to the present rules will be filed with the bailiff's office that holds the present rules.

Article 15
‍
Use of the winners' identity
‍
The Candidates agree that their name, first name, position, city of residence as well as any recording of their image or the sound of their voice made during the awards ceremony may appear for ten (10) years from the date of their participation in the awards ceremony on online advertising media (the Organizing Company's websites, communication media (brochures, application files, invitation card, emailing, press publications, Hospitality ON magazine) and printed materials related to the Hospitality Awards, worldwide and without reference, payment or compensation other than the awarding of their trophy / diploma.

Article 16

Submission of regulations
‍
Candidates accept the entirety of these rules, which are filed with the Bailiffs of justice. It is reminded that the names of the finalists and/or winners of each category will be given by the president of each jury to the bailiff who will bring them in a sealed envelope during the ceremony that will take place on November 30, 2021.

Article 17
‍
Interpretation of the regulation and attribution of jurisdiction
‍
Any dispute concerning the interpretation of these rules shall be decided solely by the Organizing Body. No written or verbal request concerning the mechanism of the event, or the interpretation of the rules will be answered.

In accordance with the provisions of Article 2254 of the French Civil Code, any action by Candidates against the Organizing Body arising from the validity, interpretation, performance or non-performance, interruption or termination of these rules shall be barred within one year of the award ceremony.

These rules (including their interpretation and any disputes arising from them) are governed by French law.

ANY LITIGATION ARISING FROM THE VALIDITY, INTERPRETATION, EXECUTION OR NON-EXECUTION, INTERRUPTION OR TERMINATION OF THE RULES SHALL BE SUBMITTED TO THE COMMERCIAL COURT OF PARIS.

These rules (including their interpretation and any disputes arising from them) are governed by French law.

Article 18

« Informatique et libertés » law
‍
Personal data of participants and Candidates will be collected and processed solely for the purposes of organizing the Event. In accordance with the law "informatique et libertés" of January 6, 1978, each participant and each Candidate has the right to access, rectify or delete information concerning him/her by sending a letter to the following address Hospitality ON - Hospitality Awards 5 rue de Danzig, 75015 PARIS France. All participants and candidates may object to the processing of their data for marketing purposes.

Article 20

Transfer of copyright and author's rights

It is expressly agreed that participation in the Event entails the transfer by the Candidates, to the benefit of the Organizing Body, of all copyrights relating to their application file as well as to any element provided within the framework of the Event, except for the logo of their brand. In this regard, the Candidates acknowledge that they are giving up free of charge their rights of reproduction, representation and adaptation of their contribution(s) to the Organizing Body, for the entire world and for the entire duration of the legal protection of said rights in France, on all digital media (websites, social networks, community platforms, mobile applications, etc.) and printed media (books, guides, leaflets, brochures, posters, postcards, etc.) for commercial, promotional and/or advertising purposes by the Organizing Body and for its activities, products and/or services. The Candidate affirms that he/she is the author of the contributions he/she submits and guarantees that the works submitted are original and unpublished. In this respect, the Candidate is responsible for obtaining the authorizations of any third party having directly or indirectly participated in the creation of the contribution and/or who consider that they have any right to claim against it. The Respondent shall be responsible for any payments arising from such authorizations. In general, the Candidate guarantees the Organizing Body against any recourse, action or claim that any third party may make, in any capacity whatsoever, in connection with the exercise of the authorizations granted herein and, more generally, in connection with all guarantees and commitments made under these rules.

The Candidate agrees to hold the Organizing Body harmless from any claims by third parties due to copyright infringement or violation of exploitation or property rights, regardless of the nature thereof. In addition, the Applicant must ensure that the images, sounds and videos transmitted as part of the event do not violate the intellectual property rights or image rights of third parties. The Candidate shall be responsible for obtaining from any third party any license or authorization to use these elements in the context of the event and shall also ensure that these elements may be used commercially by the Organizing Body.
